When Marine Midland Man Acquitted In Theft From Sleeping Woman Jeffrey McQuiller, 22, of 11 Church Lackawanna, was acquitted Monday of second-degree burglary and third-degree grand larceny in the theft of $260 from a sleeping woman who had the money pinned to her bra. A State Supreme Court jury of seven men and five women found McQuiller innocent after more than five hours of deliberation. McQuiller was charged with breaking into the apartment of Dixie Edwards in the Baker Homes on O'Dell Lackawanna, about 3:30 AM May 23, 1976.
and taking the money from her while she was asleep. During the trial before Justice Jerome B. E. Wolff, the woman testified that she was sleeping with the light on when she felt someone touch her shoulder, awakened and saw a man grab the money and run. She identified McQuiller as the man.
However, defense attorney Peter A. Vinolus called three alibi witnesses who testified that McQuiller was with them at a party at the time of the burglary. She suffered head, leg and rib injuries and was charged with driving while intoxicated by Erie County sheriff deputies. Also injured in the accident was Mrs. Barbara Schley, 21, of Houghton, another passenger, who was transferred from the Springville hospital to Buffalo General Hospital. She suffered a fractured back.
